While the circumstances for every slip and fall case are different, the source for our blog post today does have a unique setting. A man who was 38 years old in 2013 was playing indoor soccer on a rubberized floor at a gym when he slipped and fell on a puddle caused by a leak from the ceiling. The fall broke his ankle in several places, and the man needed three surgeries to correct the issue.
That man is now 42 years old, and his slip and fall lawsuit against the community center that hosted the soccer game he was playing in was recently settled for $450,000.
There are a couple of things to learn from this story, with the first being that slip and fall lawsuits are often settled out of court. This is more of a "mindset" lesson. If you are the victim of a slip and fall, you shouldn't be thinking that your civil lawsuit will play out in front of a judge in a courtroom like on TV. Instead, it is highly likely that the two parties involved -- you and the defendant(s) -- will engage in negotiations to settle the lawsuit out of court.
The other lesson here is that not every institution or building follows safety standards. A leak from the ceiling should warrant immediate action by the building or company in charge. But many times, these issues go unaddressed, and as such, innocent people can suffer greatly. Hold these negligent parties responsible with a premises liability lawsuit.
