Can older people sue over a slip and fall?

You probably have heard that older people are just prone to falling. In fact, the National Council on Aging (NCOA) says that falls are the single biggest cause of injuries -- fatal and otherwise -- among adults over 65 years of age.

Yet, as the NCOA is quick to point out, falling isn't necessarily inevitable just because someone is old. There are numerous factors that can contribute to whether or not a senior falls -- and many of them might have nothing to do with age.

It's entirely possible, however, that there's more consciousness about seniors falling simply because the consequences of a simple fall from standing height can be a lot more serious for someone who is older than someone young might experience. While anybody can suffer a serious injury in a slip-and-fall accident, seniors are much more likely to have age-related conditions and brittle bones that could make recovery much harder.

Ultimately, it doesn't matter how old someone is: If they're injured through someone else's negligence, they may be entitled to compensation for their losses. An attorney can help an older victim of a slip-and-fall accident evaluate the incident and determine the essential questions:

  • Did the property owner have a duty toward the injury victim to keep the premises safe?
